Terms and conditions of sale
Responsibility/Liability: CAVS DI GRAZIOLI DENIS is not liable for any loss or damage, direct and / or indirect, arising from the sale of goods and services proposed in the catalog published on the website, including delayed and / or non-delivery of the product, for correspondence of goods to specifications published on the site, nor for any other circumstances not directly attributable to CAVS DI GRAZIOLI DENIS.
Risk and Property : The goods are shipped freight prepaid (Am); if the goods were shipped freight collect (am) under indication of the customer, the risk is deemed to be incurred by the customer after delivery of goods to the carrier in their stores.
Upon delivery of the goods, the customer must verify the integrity of the packages and that the goods concur with the quantity and quality as specified in the accompanying document (DDT).
In case of any differences, it should be reported on the same document and confirmed within seven days by fax or registered mail to CAVS DI GRAZIOLI DENIS and the details visible in this website.
Despite the packaging being intact, the goods should be verified within seven days of receipt. Any hidden defects must be reported in writing by fax or registered mail as per above.
Any statement over the above terms, will not be taken into account or considered. For each and any statement, the customer assumes the full responsibility of the statements made.
Orders:
Once the customer sends an electronic order over the internet, at the end of the procedure he/she will receive a confirmation of order receipts via (E-mail) and a corresponding order number.
Prices:
All prices shown on the website are included of VAT. Prices are subject to change without warning or notice.
CAVS DI GRAZIOLI DENIS, reserves the right of not to proceed with the shipment of the goods, even after receiving the orders, to those customers not considered creditworthy or with unresolved/disputed debts.

SHIPMENTS
CAVS DI GRAZIOLI DENIS acknowledges receipt of the order by sending an automatic e-mail summary to the email address provided by the customer in the order.
If any items selected is currently not available, these will be delivered within the timescale originally communicated at the time of purchase.
If longer time-frames are required, or problems arise in processing the order, you will be promptly notified to the contacts provided by the customer in the registration.
CAVS DI GRAZIOLI DENIS prepares the goods contained in the order and relies on the safe handling of the shipper with the original packaging of the manufacturer or with cardboard boxes properly closed, or with plastic-sealed bags with the logo of the courier used.
Deliveries are made on weekdays, Monday through Friday, except holidays (“deliveries made the following day”).
For hours is meant the hours included in business days.
CAVS DI GRAZIOLI DENIS reserves the right of using of one or more carriers for shipments. Delivery costs are charged to the customer and paid on completion of the order.
Upon delivery of the goods by the Courier, the customer is required to check:
- The number of boxes is the same as indicated in the accompanying document of the Courier
- That the packaging is not damaged, or wet or altered.
- Sign the shipping note
Once the shipping note is signed, the Customer may not make any objection about the quantity and quality of what they received.
Time and methods of shipment: Standard delivery
This is a kerbside delivery made during business days from 08:30 to 18:00. The first delivery is made without notice.
In the absence of the customer, the courier will leave a notice of attempted delivery (slip in the mailbox or sticker on the bell) and will retry the delivery the next business day.
If the customer is still absent he/she will be contacted directly by the courier for a third attempt.
If this attempt of delivery is not successful, the customer will be contacted by the staff of the CAVS DI GRAZIOLI DENIS to arrange a further delivery.
If the fourth attempt were to fail, the product will be sent back to the CAVS DI GRAZIOLI DENIS warehouses resulting in the cancellation of the order and subsequent reimbursement according to the method of payment..

The courier will collect the products from our warehouse in accordance with the payment method chosen and the product availability
PayPal payments:
The product will be collected by the courier the next working day of the accepted order placement
Bank transfer
Products are assigned to the Courier on the business day following the date of receipt of the payment of the full amount in to the account of CAVS DI GRAZIOLI DENIS (note an average of 3/5 days is normally required to receive the funds from the payment by the customer).
Compliance with the timing of shipment depends on the availability of the selected article.
Return policy and your rights:
Sales of products via the Internet are regulated in the Articles 50 to 68 ('distance contracts') of Legislative Decree 206/2005 (Consumer Code).
This legislation protect the consumer with the right to terminate the contract or proposed contract, guaranteeing the right to return the product purchased and the reimbursement of expenses incurred.
The right of withdrawal must be exercised by the customer, under penalty of invalidation, by sending a registered letter, to CAVS DI GRAZIOLI DENIS - Via E.Lussu, 252 - 63811 Sant'Elpidio a Mare (FM) within 10 (ten ) working days of receipt the goods.
The above communication can be sent, within the same period, by telegram or fax, if it is confirmed by registered letter within 48 (forty eight) hours after sending the telegram or fax.
Shipments, sufficiently stamped, must be strictly accompanied by a letter explaining the reason for the return and a copy of the receipt.
C.O.D. (cash on delivery) parcels will not accepted.
The following products are excluded from the right of substitution: Items marked as not available and tailored to the client's request - unless it is faulty or damaged goods.
Upon receipt of the product (and verified their integrity) CAVS DI GRAZIOLI DENIS shall, as soon as possible, credit the customer with the cost of the returned products (as indicated on the invoice).
The consumer-purchaser will be entitled to get the amount paid to the seller by way of shipping charges; following the exercise of the right of withdrawal, the consumer will still have to pay the cost to send back the goods to the seller.
Reimbursement payments are carried out via bank account. Therefore, please notify us together to return the complete IBAN.
Subject to any applicable mandatory provisions of law for the protection of consumers, any dispute related to these Terms and Conditions shall be referred exclusively to the jurisdiction of Macerata (Italy).
